However, the Commerce Clause grants authority to the government to regulate commerce and make laws that protect the rights of individuals. While these laws don’t directly target individuals, they are still a great way to combat fraud and money laundering. A government should focus on individual responsibility and consequences of actions.
Should Online Gambling Be Legal?
If online gambling is legal, it will make the industry more secure. With electronic payment processing, preventing fraud and minimizing online fraud will be much easier. Furthermore, a safer environment will encourage players to participate. Top online casinos will use SSL encryption and firewalls to protect their customers’ data. Additionally, the money generated by online gambling will go towards improving education and infrastructure, rather than corrupting the public. But the question of whether or not online gambling is legal is far from over.
States are unlikely to enforce their own Internet gambling laws. The Commerce Clause doctrine has even blocked state efforts to regulate Indian reservations within their state borders. The federal Indian Gaming Regulatory Act, which governs casino gambling on Indian reservations, does not preempt state action in the Internet.
The National Gambling Amendment of 2008 would regulate online gambling, which contributes about 1% of the country’s GDP. It has also led to the opening of many online poker sites in South Africa, which offer players the opportunity to win real cash while playing card games online. However, if legalized in the country, the impact on the South African economy will be minimal. And if online gambling is not legalized, the country will continue to suffer from a declining economy.
